Q: My Husband Need Me to Give Divorce
My Husband Need me to give him divorce . He has my son with him and not allowing to see my son or talk with him . Iam ready to give divorce but i need my son to be with me . He is doing all this to give me divorce and he dont want to pay any maintenance . he dont love my son he is using them for negotiation . What do you suggest i do ?

In fact the matter requires detailed discussion..we need to get the child through other legal sources, then approach the court in such a way that the custody of the child will remain with you .. there are provisions for that. Further if he files for divorce in between you need to contest it till the custody becomes clear … once the custody becomes safe, we can file to get maintenance too
Q: First Cousin Marriage India- Please help
Me and my first cousin are hindus from Kerala, India. We want to get married, but from my research it seems it wouldn’t be possible, even under the special marriage act. We do not have such customs either.I was wondering if signing an affidavit saying we are atheists, would help us enforce a different law , that i am not aware of. If not would it be an issue if me and my cousin live together, without us being married.

There is no issues if you both live together . Though the roti ally , marriage between prohibited decrees of relationships are there , on a practical point of view all these are happening.. so you can proceed with marriage also

We have 46centa of land which surrounds private property.we have been using way which was my sister in laws property for more than 20 years.Now she is asking huge amount from us for the permission to use it.which was 8 times higher than the actual amount

The right of way is there and is called easement right .. the right is subject to the circumstances… we need to peruse the document of the property as well see the exact site and lay out to have an authoritative comment on the right … there is least chance for her to claim the amount it seems from the facts mentioned by you

This is a matter to be dealt with more tactfully than legally… there is no much scope for a criminal action in this as per the details known… but there is a scope for a civil action that needs to be taken care about…
