Will signed under undue influence is it valid
23-Mar-2023 (In Wills / Trusts Law)
My two brothers got a will signed by my ailing father during his last few days and got the whole agricultural land transferred to their names. This land was transferred to my father through my grandfather. I want to challenge this in court. Could my father do this will at all, for the property that he got from his dad ? PS: I am a hindu by religion
No your father can not make any such will as the property in question was inherited by your father from your Grandfather which makes it ancestral in nature in which you can claim your share. You will have to file a partition suit in the civil court claiming your share in the property.
