what to do, if i have registered a will and have to make a new will
28-Sep-2023 (In Wills / Trusts Law)
I had made a registered will earlier, if I want to make a new will, do I need to register the new will also? Can I keep the new will unregistered or notarized? Do I need to revoke the earlier registered Will, if so what is the process of revoking a previously registered WILL.
Which is an instrument which is not compulsorily to be registered. But if you want to execute a new will you may register the same or not but it is safe to revoke the earlier registered will or make a simple declaration and make it registered and for that you have to execute a separate deed and register the same before the same registry office at which you have registered your earlier will. And it is very much essential to state the reason behind revoking the earlier will In The said revocation deed or the declared.
When you are making a new Will, the writing i.e. drafting must be made such that the previous Will is revoked. You may not register the new Will. But, without the Probate of the Will, the Will is just a mere piece of paper. Thus, when a suit / case will be filed, a registered Will would be a stronger point for the executor of the Will.
