Procedure to make will for the ancestral property

I want to be co owner of property which is in court ..It's ancestral & it is in my brothers name. I do not believe that I might not get share in future so I want make a will in both of our names ..I want to know how can I do that and what is the procedure. Thank you

Since the property is subject-matter in a court case, you cannot become a co-owner other than through the Court order. If you create a Will for a property that is not yours as on the date of making the Will, then the Will will not be valid. If you are already a party to the case, you have to wait for the case to be concluded. If you are not a party in the case, then it would be advisable to file an Impleading Application and make yourself a party to the case so that you are aware of the proceedings and you can also defend your position.
