How to initiate a case against disputed will

Behror, Rajasthan The disputed will is examined by our expert (retd Add Dir. of state fsl ) u/s 45 and proven fabricated after death. After 6yrs we wanna institute criminal proceedings. Should we apply u/s 340 CrPC and wait or directly file application u/s 202 to CJM. Only one cross-exam.of our witness is left in march.
