Does grandson have access to grandfather's will to know his share ?
03-Jan-2023 (In Wills / Trusts Law)
My question is regarding my ancestral house. I am the only grandson of my grandfather who inherited this house from his grandfather. Below are the facts with regards to this property: - My grandfather now deceased has 3 sons (all married) living in this house and 4 daughters (all married). none of them live in this house. - I am the only grandson but I have been told to leave the house by my father. All the granddaughters have been married now and there are a total of 7 people living in this house currently. - I along with my wife and a young daughter are currently working in another city living in a rented apartment. - I dont know if there was a will that my grand father left but my father says that there was. I would like to know: - If I want to live in that house, do I have the right to do so & how? - I would like to use the ground floor of the house to open the same old shop that used to be there, am i eligible to do so and how? - Can i access the copy of the will ?
You said that your grandfather inherited the house from his grandfather. After the passing of Hindu Succession Act,1956 the property got in inheritance will be deemed self acquired property. So when your grandfather died his said house (property) has been devolved upon his immediate heirs i.e. his sons, daughters and widow (if alive). So you can't claim the house against your father.
