Can I claim the tax refund amount if I am not staying at property now

07-Dec-2023 (In Tax Law)

Dear Sir, I sold my dahisa 2BHK apartment in December 2013. I lived there from 2008. There were property tax refunds made by BMC from 2010 -2012, and my society has received the same. Can i claim for this as i was residing there during 2010-2012 OR the new owner is entitled to get this amount. Could you please let me know. Thanks.

What did the agreement to sell and the sale deed provide for. If the sale deed provided that you as erstwhile owner will be entitled to all benefits/ liable for all liabilities unto the date of sale, you can make a claim for such refund. One would require to analyse the sale deed.
