Withdraw Writ Petition from Bombay HC

Sorry for asking this question under SC section but it was the most relevant. I have a criminal writ petition matter pending in the Bombay HC and it is in the pre admission stage. There has not been a single hearing. It was filed in 2018 but now both the parties have settled the matter outside court. It was related to maintenance amount passed by a lower court. Now, I want to withdraw the writ petition as the matter is already settled. What is the procedure? The lawyer who filed my writ petition is no longer in the city now, so what to do now if he is not available?

Hi,

you can move praecipe before High Court and get your matter listed for withdrawal. The Court will immediately allow you to withdraw your Petition. Judgement will be delivered by recording the reasons of withdrawal. This is the only procedure you need to follow.
