Query on Special Leave Petition and stay order

22-Apr-2024 (In Supreme Court Law)
We are fighting a civil case with our tenants since 2005. Trial Court - We won in 2012. 1st Appellate Court - We won in 2020. High Court of Bombay - We won on 24th January 2024. Supreme Court - Petitioners have filed an SLP on 10th April 2024 and it has been listed under Defect List. Question - Can the judge in the Trial Court give the eviction order for the tenants to vacate the property since there is no stay from the Supreme Court. FYI - Our next hearing in Trial court is on 8th May 2024.

Well, if you have filed a case in the Civil Trial Court to seek eviction of the tenants and the case is at the last stage of Judgement and Order, then, of course, if there is no stay by the Supreme Court on the eviction, then, the Trial Court can order eviction of the tenants from the Property.
