can I file a New written statement

I engaged a careless lawyer and he filed a vague written statement, now I want to file a new written statement. I researched on my own and found out that i can do so in rule 9 order 8. can I ask the court for permission to file a new ws or should go for amendment?

Yes...you can always move an application under Order 8 Rule 9 CPC for providing additional written statement and you need to satisfy the court that some important points were left during filing of the initial written statement.

What is the stage of the matter. Subject to that, you may have to file an amendment only, however you will have to figure out a proper reason. In the absence of a cogent reason, amendment might be problematic.
