Cheating by manufacturing company

Sir,
1.We are startup retail company and we ordered some goods to manufacturing company and paid the advance amount(30%).
2.He confirmed to us for delivery on 17/09/2018.but still he is not delivering the goods and everyday we are following with him.
3.one day we shouted about delivery ,he told that he used our advance amount for other business client for manufacturing the goods and told once he got the amount from that client he will refund advance amount.
4.When we raised the concern about used our money for other business purpose, he is shouting.
5.he cheated us and used our money for other business purpose.
6.Still he is not refund the advance amount and everyday he is saying will refund tomorrow.
Kindly help us for get our advance amount legal way,
Section 415 can be applied to this matter and a criminal complaint may be lodged. If he has assets, i would highly recommend that you file a Money Suit and attach the property to ensure that your money is recoverable.
