Wrongful auction notice, Trespass, and Damage

11-Aug-2025 (In Recovery Law)
I own a flat in Neral with home loan from Bank XYZ, not ICICI. ICICI’s recovery agents wrongly affixed defaulter/auction notices on my door meant for another borrower (due to same flat numbers in different buildings). They broke my lock and entered without consent for flat inspection, after which appliances were stolen. I don't stay there. They didn't involve the society. How can I ensure that the bank corrects its mistake and does not create complications when I try to sell the flat?

You should immediately send a detailed legal notice to ICICI Bank demanding correction of records, withdrawal of any notices, and written clarification that you are not their borrower. Enclose proof of your ownership and home loan from Bank XYZ. Also lodge a police complaint for trespass, theft, and criminal intimidation against the recovery agents, mentioning the mistaken identity. Inform your housing society in writing to maintain records. Simultaneously, file a complaint with the RBI Banking Ombudsman for wrongful action. This will create a documented trail, ensuring the error is rectified and preventing any title complications when you sell.
