Someone harrass my family for my dues
21-Oct-2024 (In Recovery Law)
Sir I want to ask if I'm not paying the lending money from someone so he has the right to recover that amount from my family or not??
Generally, debts that are personal and informal, such as loans from friends, are typically between the borrower and the lender. If a person borrows money from a friend and does not repay, the friend generally does not have the right to legally recover the money from the borrower's family members unless:
The family members co-signed or guaranteed the loan: If a family member explicitly agreed to be a guarantor or co-signer, then they can be held liable.
The loan was made to a family business or under joint liability: If the loan was for a family business or a similar venture where liability was shared, then it might be possible to seek recovery from family members involved.
In most cases, unless there is a specific legal agreement or contractual obligation that involves family members, they cannot be held accountable for the loan.
