I did trading in someone's account he used to give me otp on daily basis.but after some profit there was loss. Now that person asking me to pay him all his capital for which he took some blank cheque forcing me.also harassment with family.
I understand this is an incredibly stressful and frightening situation. You've found yourself in a complex mess that involves financial losses, coercion, and personal threats. Let's break this down systematically. You have a strong defense, but you need to act strategically and immediately to protect yourself and your family
The Core of the Matter: Liability for Trading Losses
First, let's address his demand for the entire capital back. In any investment or trading scenario, there is an inherent risk of loss. The fact that he provided you with OTPs on a daily basis is crucial. This act demonstrates his active consent and participation in the trading activity. He was aware that you were accessing his account and executing trades.
The Immediate Danger: The Blank Cheques he can misuse of that cheque.
Now, let's turn the tables. His actions of forcing you to give him blank cheques and harassing your family are not just aggressive; they are illegal. He is the one committing serious offenses under the Bharatiya Nyaya Sanhita, 2023 (BNS).
like Extortion (Section 318, BNS) and
Criminal Intimidation (Section 351, BNS)
This situation requires firmness and swift legal action. The combination of a stop payment instruction, a strong legal notice, and a police complaint for extortion is your most effective strategy. It shifts the entire narrative and puts him on the defensive. Please consult a qualified lawyer immediately to execute these steps.
