Family in severe financial distress for 5+ years (father unemployed, sold house,cars,jewellery). My elder sister & I took ₹50L+₹43L unsecured NBFC education loans for MS in US but returned jobless due to current market. EMIs begin next year but unaffordable as I’m unemployed and my sister’s income only covers household expenses. No savings/assets and dad’s credit cards are in NPA. Lender & RBI rejected restructuring requests. Seeking urgent legal guidance on next steps. Thank you.

Your financial situation does not create immunity from loan liability, but lenders cannot force illegal recovery. Since restructuring has been rejected and the accounts are already classified as NPA, the correct next legal step is to prevent coercive action and negotiate a lawful settlement strategy. You may initiate proceedings under the RBI Fair Practices Code and SARFAESI norms if any lender or NBFC adopts harassment, unauthorized recovery agents, or threatens seizure without due process. For unsecured educational loans, lenders cannot attach personal properties without a decree from a court; they must first file a civil suit for recovery. Until a decree is passed, there is no automatic right of attachment. Your priority should be to formally communicate financial hardship through a written representation citing loss of employment and request either One-Time Settlement (OTS) or extension of moratorium. Maintain all correspondence as evidence. Do not ignore notices, as that can accelerate enforcement. Respond to each communication legally and seek time-bound restructuring. If lenders violate RBI recovery guidelines, you can escalate the issue before the Banking Ombudsman or file a complaint before the consumer or civil court for unfair recovery practices.
