Refund of Rs 16000/- paid as advance due to non startingt the work

28-Oct-2025 (In Recovery Law)
I have entrusted work of Cool quoting of terrace and damp proof paining to outer wall for Rs 28000/-.. I have paid Rs 16000/- as advance through PhonePe during 5/2025. I requested to refund the advance, as work was not started. The firm neither started the work nor refund the amount. I file a case in District Consumer forum. The firm has neither attend the court nor file the counter. The forum has directed me to file evidence affidavit. Pl send relavant affidavit

Since the firm has failed to start the contracted work and also did not refund the amount, it clearly constitutes Deficiency in Service and Unfair Trade Practice under the Consumer Protection Act, 2019. As the opposite party has neither appeared before the District Consumer Forum nor filed any counter, the matter is now ex-parte against them. You must file an Evidence Affidavit with: • Proof of payment (PhonePe screenshots / bank statement) • Copy of work order / bill / messages confirming agreement • Written communications demanding refund • Complaint copy and case details After submission, you can also seek refund of ₹16,000, interest, compensation for mental agony, and litigation expenses. If required, I can assist in drafting the affidavit in proper Consumer Forum format.
