Recovery of money spent on laptop given as loan – unpaid

21-Jan-2026 (In Recovery Law)
I purchased a laptop worth approximately ₹1,00,000 for a person about 3 years ago on his request, with a clear understanding that he would repay the amount slowly after getting a job. The laptop was for his exclusive use. I have WhatsApp messages proof confirming the promise to repay. The amount has not been returned yet. I do not want the laptop back, only money recovery with reasonable interest. Please advise on limitation, legal notice, and chances of recovery.

Since you purchased the laptop for him on the clear promise of repayment, it amounts to a recoverable debt / loan/advance. Your WhatsApp chats acknowledging the promise to repay are admissible electronic evidence (with proper certificate under Section 65B, Indian Evidence Act). Limitation: A money recovery claim is generally within 3 years from the date the amount became due / from the last acknowledgment of liability or part-payment. If the last written acknowledgment (WhatsApp) is within 3 years, limitation gets refreshed. Immediate action: Send a strong legal notice demanding payment within 7/15 days with reasonable interest and costs. If he fails, file a Summary Suit under Order XXXVII CPC (fast-track money recovery) for ₹1,00,000 + interest, relying on chats and proof of payment/invoice. Simultaneously, if there was dishonest intention from the beginning, you may also consider criminal action for cheating (IPC 420/406 as applicable). Chances of recovery: Good, provided you have invoice/UPI-bank proof and WhatsApp acknowledgment. Court can award interest + costs.
