Recovery in drt by corporation Bank against me for a loan of flat that

I have booked a flat in greater Noida for RS 45 laks. I gave them 10 lakh and then I took a loan of 19 lakh from corporation Bank. But the builder stopped construction after 2 year. Till then I paid my emi against 16 lakh released by bank. After that I filled my case in consumer Court in Delhi. But bank went to drt for recovery. What I should do?

Did the bank have a tripartite agreements with you and builder or was it a normal home loan? If the builder has even stopped construction, bank has the right to move to drt and recover from you.
I would suggest you to file a criminal complaint against the builder and also appear before Drt before the bank proceed ex parte.

Contest your case before DRT and explain the factual scenario. In the meantime, you should file a case before a civil court for recovery of money from the builder. There is no bar to approach the civil court and the consumer court simultaneously . Both the matters can be heard parallely.
