As an advocate, Under Indian law, a partner in a registered partnership firm generally cannot unilaterally file a civil suit for recovery when there's an existing dispute with other partners, especially if the suit seeks to enforce a right arising from the partnership contract. While partners usually have implied authority to act for the firm in the ordinary course of business, this authority doesn't extend to disputes among partners. Section 69(1) of the Indian Partnership Act, 1932, specifically bars a partner of an unregistered firm from suing the firm or another partner to enforce contractual rights or rights under the Act. Even for registered firms, if the suit is for individual recovery against another partner and not for dissolution or accounts of a dissolved firm (which are specific exceptions), express authorization from other partners or a clear basis for individual recovery, independent of the firm's general business, would typically be required to maintain such a suit. The Partnership Deed is also crucial as it may contain specific clauses regarding dispute resolution and litigation authority.
