Query Regarding Maintainability of SLP Prayer for Reference to KRERA
18-Jul-2026 (In Recovery Law)
Respected Learned Advocate(s),
I seek your considered opinion regarding the most appropriate legal remedy available after dismissal of my Consumer Complaint by the DCDRC, SCDRC, NCDRC and the Review Application by the NCDRC.
Throughout the consumer proceedings, my principal prayers were for directions to the Builder to furnish mandatory documents, execute the Apartment Buyer's Agreement/Sale Deed, facilitate housing finance, complete the sale transaction and deliver possession.
Since your consumer case has been dismissed up to the NCDRC Review, the next remedy may be an SLP before the Supreme Court, if there are substantial legal grounds. Depending on the facts and the dismissal orders, a civil suit for specific performance/mandatory injunction or proceedings under RERA (if maintainable) may also be available. The dismissal orders need to be examined before advising the best course.
Based on the facts stated, once the Consumer Complaint has been dismissed by the District Commission, State Commission and National Commission, and even the Review Application before the National Commission has also been dismissed, the next legal remedy may be to examine the maintainability of a Special Leave Petition (SLP) under Article 136 of the Constitution of India before the Hon'ble Supreme Court, if there are substantial questions of law or jurisdictional errors. Depending on the facts, it may also be necessary to evaluate whether any independent civil remedy for specific performance, execution of the sale deed, possession, or damages is maintainable, provided it is not barred by limitation or other legal principles. Since the appropriate remedy depends upon the complete record, orders passed by the Consumer Commissions and the reliefs sought, it would be advisable to obtain a detailed legal opinion after examining all relevant documents.
