PG Owner not returning my Security amount
08-Jun-2026 (In Recovery Law)
Hi,
I work in Gurgaon and was staying in a PG in Sector 22A. At the time of joining, I paid both the security deposit and the rent amount.
On April 1, 2026, I informed the PG owner that I would be vacating the room, and he acknowledged and agreed to it. I vacated the PG on May 2, 2026.
However, it has now been more than a month since I moved out, and the owner has still not returned my security deposit. Whenever I follow up, he keeps saying that he will return the money "today" or "tomorrow,"
Based on the facts stated, the PG owner cannot indefinitely withhold your security deposit without any lawful justification. If you have already vacated the premises after giving prior notice and there are no outstanding dues or proven damages, you are legally entitled to seek refund of the security deposit.
Preserve all relevant evidence, including rent receipts, deposit payment proof, messages regarding notice of vacating, acknowledgment by the owner, and subsequent communications promising repayment. Issue a formal legal notice demanding refund within a specified time. In the event of continued non-payment, you may initiate appropriate civil and consumer proceedings for recovery of the deposit amount along with interest and litigation costs.
Repeated assurances of payment without actual refund may strengthen your case and indicate an unjustified withholding of your money.
