paying guest refusing to return advanced payment

sir/mam i am a student from bulandshahr i am living in delhi in a pg for my jee coaching i belong to middle or somewhere between middle and lower middle class family i am paying 10500 per month for my room i came here in april and we have a agreement(not written just oral)with lawyer of 1 year to stay now in dec i have to leave because of some urgent issue i payed them 1 month in advanced means i have already paid them for january but they are refusing to refund that money..sir is it legal ??

Your security deposit and advance rent should be refunded if you provide reasonable notice of vacating, even without a written agreement. An oral rental agreement is legally valid under Contract Act. Since you're leaving due to urgent issues and have informed them in December for January, this is reasonable notice. Your landlord/PG owner cannot unfairly withhold your advance rent of Rs. 10,500. You can: 1. Send a written notice (WhatsApp/email) documenting your request for refund 2. If they refuse, file a complaint in local police station 3.
