Party neither delivering goods nor giving refund

Dear Sir, I had a deal on the phone on 8 aug 2018 to new party and according to that I sent the purchase order and then I received the performa invoice and i paid the 30% advance payment against the deal .since 10 days he refused to send the goods and also he is denying to refund the amount Rs 170982..What Should be done Sir???I have all the emails and NEFT Copy of payment done.

1. Firstly , Remaind that dealer as a final remainder for payment .
2. Secondly , Send a appropriate legal notice through a lawyer for recovery of amount / payment .
3. Thirdly , Mentioned all the minute details in the legal notice & final remainder also mentioned .
4. Put in the legal notice to launch & under the shelter of as Civil as well as Criminal legal action initiating , if payment not paid within the duration of period .
