Non Payment of due amount as it is a interior done for client

Hi, we are into Interior business and the client didn't pay the balance amount and When we said if the payment not made, we will take legal action, he is threatening us to take legal action against us. Please suggest what we can do in this. How it proceeds

Hi,

I have received your legal query. I would suggest you to send a legal demand notice for clearing the outstanding dues or else he shall be liable for legal consequences in case he fails to clear the outstanding dues.

In case if you have provided them the performa invoice it is stated in it that what will be the scope of work and what will be the charges according to that invoice. if it accepted, Great.
In case no performa invoice is sent then the modus operandi will be to serve them the legal notice seeking recovery of the amount/fees for the work done and provide them 15 days time. In case this fails, filing a recovery suit will suffice your purpose. If they are threatening you to file a case against you, preferably, sending the notice firstly which will ensure your first claim will be beneficial.

We have to send a legal notice. Many times when a party receives legal notice from a lawyer, it immediately pays.

If they still don't pay then we can file a criminal complaint against them for cheating subject to the fact that they haven't paid anything. We can also file civil suit if you have documents like contract, invoices and communication with the party.
