Need Advice – Ahmedabad Court Appearance & BW Procedure in Cheque/Loan

25-May-2026 (In Recovery Law)
Hi everyone, I need some guidance regarding a cheque/loan-related case pending in Ahmedabad Magistrate Court. I was informed there may be a Bailable Warrant (BW) involved due to non-appearance. I am currently under severe financial stress and unable to arrange such a large amount. I wanted to understand: Can I appear before the court personally without an advocate?

Yes, legally you can appear personally before the Ahmedabad Magistrate Court without an advocate as a party-in-person. However, because a Bailable Warrant (BW) has been issued due to your non-appearance, appearing without proper legal representation carries risks. Upon your appearance, you must immediately move a formal application under Section 70(2) of the CrPC (or the corresponding provision of the BNSS) for the cancellation of the warrant, along with a surety or bail bond. If you cannot afford a private advocate due to financial stress, you have a legal right to approach the District Legal Services Authority (DLSA) at the court premises to get a free legal aid counsel. I highly advise against facing a warrant without legal guidance. Feel free to connect through this platform for proper assistance.
