Money given to friend in abroad only WhatsApp proof

Hi I have given money to friend in abroad, we both are now in India. We live in same state but different district, he once said he will pay me at my house in India. So can I file case in area instead of his based on WhatsApp text?

Yes, a recovery case can be filed at the place where the cause of action has arisen, wholly or in part. If the borrower has expressly acknowledged, even through WhatsApp messages, that the repayment would be made at your residence in India, such communication can be relied upon to establish territorial jurisdiction. WhatsApp chats are admissible as electronic evidence, subject to compliance with the Evidence Act. However, the facts, nature of transaction, and limitation period must be carefully examined before filing the case.

Yes, if you both are citizens of India and you have all valid documents of the money paid to the person with respect to it being not any other payment, for any other purposes other than a friendly loan. also, a civil case for recovery is filed in the place of the residence of the plaintiff or the place where transaction occurred, you can also lodge a criminal complaint for fraud, cheating and criminal breach of trust.
