lent money to a friend but even after 6 months he did not return it

06-Jan-2023 (In Recovery Law)

Dear sir/madam, I have lent 5,00,000 to my friend for her mom's hospitalization 8 months ago. Although she had agreed to repay the amount in 6 months, it got extended to 3 months more based on her financial situation. Recently I found out that her sister's original property document that she had provided to us turns out to be a color xerox and at this time we only have the Hand loan agreement and a cheque duly signed by her. Am worried as her false promises continue, and am not sure if I need to present the cheque for it to bounce and take legal action against her. Seeking your Kind advise.

I feel this question itself incomplete. Because when you took loan agreement / cheque from the party then her's sister document is not necessary. If at all her sister provided guarantee then file a suit to recover the said sum of rs 5,00,000 and seek attachment of the property . Else send the cheque for clearance. If the cheque is not cleared then file a cheque bounce case under NIA 138. and issue legal notice for recovery of said amount.

If her sister provided guarantee with her property document and you sure about the document is fake/not original then you can file criminal case according IPC 1860 u/s 420/468 .
