I paid ₹87,000 as advance against a Proforma Invoice for supply of goods. ₹11,800 design charges are accepted as non-refundable. No production or delivery was done. Supplier is refusing refund of ₹75,200 citing “no refund policy”. I need a legal notice for refund recovery and artwork/IP handover. MSME Samadhaan filing is in progress.

यदि कोई उत्पादन या डिलीवरी नहीं हुई है, तो “no refund policy” के नाम पर पूरी अग्रिम राशि रोकना कानूनी रूप से टिकाऊ नहीं है। ₹11,800 डिजाइन चार्ज यदि लिखित रूप से non-refundable स्वीकार किया गया है, तो शेष ₹75,200 की वापसी योग्य देनदारी बनती है। आपको सप्लायर को कानूनी नोटिस भेजना चाहिए, जिसमें (i) ₹75,200 की रिफंड मांग, (ii) भुगतान की तारीख से ब्याज, (iii) किसी भी तैयार किए गए आर्टवर्क/डिज़ाइन/सोर्स फाइल्स का IP हैंडओवर, और (iv) निर्धारित समयसीमा में अनुपालन न होने पर कानूनी कार्रवाई का उल्लेख हो।
