Legal Notice for Non-Payment and Fraudulent Conduct of builder

I am writing to formally demand repayment of the money I paid you in 2015 for the plot in Hinjewadi Phase 3, along with the promised returns on profits from sale of plots or at least 12% annual interest promised. Despite repeated follow-ups over the past ten years, builder has failed to honor your commitments.

You should immediately issue a detailed legal notice demanding refund of the principal amount paid in 2015 along with agreed returns or minimum 12% interest as promised. Mention breach of contract, misrepresentation and failure to perform obligations despite repeated follow-ups. Limitation is important. For recovery, limitation is generally 3 years from date of default or last written acknowledgment of liability. Check if there is any written acknowledgment, email, payment or promise within last 3 years to extend limitation. If documents support your claim, you may file civil suit for recovery with interest and costs, and also examine criminal complaint for cheating if intention was dishonest from beginning. Immediate legal action is advisable.

You may issue a legal notice demanding refund of the invested amount with agreed interest. If the builder fails to comply, file a civil suit for recovery or approach RERA/Consumer Commission for deficiency of service and unfair trade practice.

You can issue a legal notice for recovery of the amount. Is there any allotment letter issued to you or do you have any proof of payment. If he doesn’t reply to notice you can file a suit for recovery of money along with interest and compensation.
