Legal advice on personal loan recovery from family by sbi bank .

Sbi put holds on my mother account for not paying the EMI of my father's barrowed personal loan after he deceased on January 2025. Where she is not signed any loan documents. What should my mother do to get her money kept hold by sbi ?

SBI has no legal authority to freeze or hold your mother’s personal account for recovery of your late father’s personal loan unless she was a co-applicant or guarantor. If she has not signed any loan documents, she cannot be made personally liable. You should immediately submit a written representation with a copy of your father’s death certificate to the branch manager and request release of the hold. If the bank still refuses, you may file a complaint before the Banking Ombudsman or approach the civil court for appropriate relief. Consult a lawyer for recovery.
