Legal action if unable to attend court for credit card delay payment

16-Dec-2023 (In Recovery Law)
I have a credit card debt of 27,000Rs. Since I quit my job I have not been able to make the payments. I intend to start making the payments before m next due date. Unfortunately i received a Lok adalat pre litigation notice and I missed the date, as the found the notice much later. Will this cause legal action if I make a payment of 3000 before my next due daye? I checked with the bank's customer care, they said that there will not be a legal problem Please suggest. I will be travelling for the next few weeks so I will not be able to request for a new date.

Lok Adalat is an alternative dispute resolution mechanism where disputes are settled outside the court system. It is a forum for the amicable settlement of disputes between parties. If you do not show up on the due date in a Lok Adalat in the case of a delay in paying credit card bills, the consequences may include:

  1. The Lok Adalat may pass an ex-parte order against you, which means that the order will be passed in your absence.

  2. The Lok Adalat may direct the credit card company to recover the amount due along with interest and penalty charges.

  3. The credit card company may take legal action against you, which could result in the seizure of assets or garnishment of wages.

  4. Your credit score may be negatively impacted, which could make it difficult for you to obtain credit in the future.

  5. The credit card company may also blacklist you, which could make it difficult for you to obtain any kind of credit in the future.

It is important to attend the Lok Adalat and try to reach a settlement with the credit card company.
If you are unable to attend the Lok Adalat on the due date due to prior commitments or unavoidable circumstances, you should inform the Lok Adalat and the credit card company as soon as possible. It is important to provide a genuine reason for your inability to attend the Lok Adalat. If your reason is accepted by the Lok Adalat and the credit card company, they may reschedule the hearing and give you a new date to attend.

Apart from legal consequence for non payment the interest over credit will keep piling up unless you pay the amount at earliest. Further, if there is a lok adalat notice that mean there is a case in court. Since you have given inadequate details what you may do is, if you feel necessary, contact a lawyer and meet in person for detailed legal advice.

If you want to settle the account, please do it only through Court since the matter is already before the Court. Do not believe the words of the bankers/collection agents, because they resort to all kinds of lies to collect the money. They will adjust the amounts paid by you firstly for penalties and fines and will keep on harassing you. Further note that your credit rating with CIBIL will be showing negative even after settlement, therefore please settle through Court and seek a direction from the Court even for CIBIL rating.
