Jeweller not returning money invested under gold investment scheme

Hello to everyone on the forum .. I had invested a certain amount towards booking of gold with a Jewellers in Mumbai who is not giving gold neither returning money against the investment. There is no gold in the showroom and they say neither we have the money. They just keep saying we will return the money soon. This is worrisome for my hard earned money .. can i send him a legal notice to return my money or give me gold against my investment... what is the process for same... request your kind advise...

issue a legal notice to this jeweller . investigate who all from the vicinity have invested their monies with this jeweller. issuance of a legal notice will creat pressure on him . you can also file a recovery suit against such erring jeweller in the district court of appropriate jurisdiction.
