Immigration Agency Refusing to Return Money for Un-availed Services

13-Jul-2023 (In Recovery Law)
I started a process with an immigration agency which included:n1) Technical evaluationn2) Counseling roundn3) Canada Permanent Residency FilingnnAfter the first two rounds, I paid the fees for the visa filing process in advance. This was for Canada Permanent Residency. However, due to some medical emergency I told them I can't continue with them now and require some waiting period. After one month waiting period, I realized I am going to have a lot of medical costs in my home and I won't be able to continue with process of immigration. Since I had neither given IELTS not my WES ECA was done which are the beginning processes in an applicant's journey for Canada PR, I asked the agency to kindly return the money and they refused saying that my process has already started (how come? They did not even have my documents). I have not signed any kind of legal agreement with them but I have invoices of the fees I paid.

1. file a complaint with the police station against the agency for not refunding the fee paid. 2. If police do not act file complaint with the court. 3. Also file a civil suit for recovery of money. since you did not avail of the entire course and had paid advance money to the agency you are entitled to a refund.

Hi, Seems like your issue is something that may be governed by the agency’s general terms of use which may be available on their website/invoice. Additionally if this agency is a Recruiting Agency registered with MEA, filing a complaint with The Protector of Emigrants may also be an avenue that may be explored. Please feel free to contact me for any further queries/assistance.

If immigration department is not ready to refund ..then we need to check whether you have any kind of contract with them regarding whatever work they have done …..secondly we have to check whether the work is under legal liability or not …so we have to evaluate these documents in order to file recovery case …thank you n b in touch

If they are not listening to you then you can send them a legal notice and in that notice you can write either refund my money back along with compensation or face legal action. And if want to go legal then you can always forward a written complaint to the police station of your area. For more legal assistance I am just a call away.
