I need suggestion regarding below case. My friend purchased property in subvention scheme from supertech financed by Indiabulls. Now supertech has filed for insolvency but Indiabulls is still asking for emi.I stood guarantor as Indiabulls didn't have office in the state where my friend resides, now my friend is refusing to pay emi. As a guarantor can I approach his employer for deducting emi from his salary. What rights as guarantor do. I have to safeguard myself

If they are not listening to you then you can always serve them a legal notice regarding your grievances and in that notice you can write either stop all these harassment and deduct emi’s from the person who had taken loan from you. In that way you will be having a documentary evidence. For more legal assistance I am just a call away.
