i lost 21 laksh in a cyber crime fraud in stock trading, transfterred money into bank accounts of the fraudster. i filed complaint and fir got registered. Upon investigation police freezed bank accounts and recovered 10 lakhs from fraudster bank accounts. Now i need to claim my money. How, and procedure needed
Since an FIR has already been registered and part of the amount has been recovered and frozen by the police, you have a legal right to claim the recovered money through the court process. The police cannot directly release the amount to you without orders from the competent court.
Immediate Legal Steps:
1. File a petition before the jurisdictional Magistrate Court under Section 451 / 457 Cr.P.C. seeking interim custody and release of the recovered amount in your favour.
2. Submit proof of loss, including bank statements, transaction details, complaint copy, FIR, and any communication with the fraudsters.
3. The court, after verification, may pass appropriate orders for release of the recovered money to you, subject to final outcome of the criminal case.
4. Continue to follow up with the Investigating Officer to trace the remaining amount and attach further accounts or assets of the accused.
5. If required, you may also initiate parallel civil recovery proceedings for the balance amount.
Timely legal action is important to secure the recovered funds and prevent delays.
For detailed guidance, drafting, and representation before court, professional consultation is advisable.
