28-Sep-2025 (In Recovery Law)
I paid more than 10 lakh rupees to a person for giving govt job to me. But he scammed me . I paid all the money through online transfer. So i filed a recovery suit against him . 16 oct is the first hearing of this case. Now he wants to settle this matter outside the court. As a security he gave me my all amount cheque as a security. Now I want to close this matter. So what my further actions to do in court. Please suggest me.

Hi there, at first cash out the cheque and secure your amount. If the cheque is post dated then ask him to issue a fresh cheque or wait till the date and on hearing date ask for an adjournment stating the ongoing efforts for settlement. If the cheque is cleared and the amount is received then hire a lawyer and make a MOU regarding the same and submit it in the court. If you have any questions feel free to contact me.

First of all it's advisable for you to deposit the cheques in your bank account and satisfy yourself that you have received all your money back. And then on the date of hearing you can move an application along with an affidavit that you don't wish to purse this matter further.

you can file an early hearing application for withdrawal and withdraw the matter. however, you should not withdraw the matter until the cheque clears/honoured. However, you can file a case again if the cheque is dishonour. for further and detailed information you may contact me.
