I am facing certain home loan issues where builder is not giving money
25-Aug-2023 (In Recovery Law)
booked a property in 2013,sterted paying emi but due to personal reasons couldn't continue with it thus surrendered property in 2014 notifying builder regarding same.Builder forfeited downpayment,gave written assurance to return money to loaner(tripartite agreement),but didn't pay till now,mortgager pressuring us to extract money from builder rather than taking any legal action themselves.(Hindu).plz help
You can file the recovery suit under the provisions of Civil Procedure Code. Initiallly you can hire a lawyer and issue a legal notice to him for the recovery of the due money and if he does not comply with the demands then you can initiate the proceeding in various provisions of law of the country
