How to recover money in case of fraud in dealership

I have deposited Rs 80,000/- to a confessionary product company (for dealership) in there current a/c in July 2016. it is private limited company ( current status= strick off), but M D does not provide me any legal agreement nor the products for the amount given by me, when I ask he continuously giving me excuses and asks for more time, now from few months he is not responding to my call. plz advice me how i can recover my amount (i have the cash deposit counter slip) can I file suit u/s 420 fraud, what papers will be required ??
1. Firstly , Send a legal notice through a lawyer about the recovery of money which is intentionly possessed .
2. Secondly , reply of such legal notice is not proper & in case of absence then file report to the nearest police station , which the cause of action arose in subsequent jurisdiction .
