How can I recover money from my cousin when I have no proof of payment

My self  I had given money to one of my cousin. Since 7 month ago. And I don't have any proof for that. Now he is not giving me back so what's the procedure

firstly try to request orally with friendly atmosphere and take cheque from him but if cheque bounce you can file 138 NI act case and you can send notice through advocate, and if no response can file recovery suit
