Hi - i had taken a car loan for a friend, The car was in my name but being used by my friend. He was paying EMIs regularly but since covid he has stopped paying. Initially it was due to covid he had financial difficultly so gave him time to pay post covid, He has since stopped picking my calls & deliberately. It's been 2 years. Can I file any case against him for cheating. There was no legal written agreement between me & him since he was a childhood friend. But I do have witness who can testify & I also have a call recording where in he has admitted to taking loan & defaulting & promising to pay back.....Pls advise

You should first of all serve him a legal notice and in that notice you can write either pay the EMI or pay your money back along with compensation or face legal action. And if want to go legal then you can always forward a written complaint to the police station of your area. For more legal assistance I am just a call away.
