Hello, My mother took business loan from a bank around 4.5lakh. Now the current outstanding is 3.27lakh. But the business was not a success, So My mother couldn't pay loan for some years and now they put overdue or late fees and made it around 22lakh. I heard that they can only put case in DRT when the minimum payable amount is greater than 20lakh. So is it right that the bank put a case in DRT? got summons from DRT. But now my mother and my situation is worst. My father got absconded and now me and my mother is living with my uncle. My mother or me don't have a single asset or property or a single rupee savings, and my uncle has too much of a loan debt himself, so he can't pay this loan right now. Now our whole situation is worst. We are having too much financial trouble. What should My mother do? She should appear in court? or should not go? because we are unable to pay the loan right now. we need time, atleast until i get a job.

if the absconder doesn't respond then the employer can file a civil suit in case the absconder has pending loans and advances, pre-paid dues, loaner devices etc. Section 82 of the Code of Criminal Procedure deals with the offense of evading a firm so that the corporation can file a lawsuit against the absconder.
