Friend refusing to return money lent to him via bank transaction

My case is , one of my colleague and a friend took 50000 rupees from and he told me he will return back in 3 or 4 slot . And I transferred that amount through my Bank internet banking through NEFT , that is the only proof I have and I have his aadhaar card Xerox . And I found he is looking like interstate Fraud . Now I am asking my money return back since he joined to another place for new job . He is telling he will not give back the money and telling do what ever you want . I need advice what I can do to return my money back keeping this proof . Thanks and regards

1. Send legal notice via advocate.
2. File suit for recovery of amount against him before court and simultaneously file police complaint against him for laying fraud, cheating and criminal breach of trust.

As per you Querry ,

1. Firstly Send the strong fact averment Legal Notice but not subject to mentioned in that Notice the said amount you gave in the form of interest taking any of the part thereof .

2. Only showing the bank transaction & aadhar card proof & he promissed to pay the remaining amount for the sake of trust worthiness but he breach the trust .

3. Send A Simple & Plane Drafting of such Legal Notice through any of the advocate & mentioned all the minute details which subject to breach the trust . Put Civil as well as Criminal action contrained against your friend.

There are couple of options. Since you have not given complete facts of the case I am writing based on some presumptions. I suggest you send him a legal notice through a lawyer clearly alleging his intention never to pay the money borrowed from you. Now after that you can either file suit for recovery and damages in civil court or you may consider filing criminal complaint for cheating in police station or criminal court. Criminal complaints in police station are usually effective if properly handled.
