Email accepting nonpayment admissible proof while filing summary suit?

24-Aug-2023 (In Recovery Law)
A pvt ltd company owes me 9 lakhs for pending salaries. MOU cum Agreement signed between us on 11th November 2022. Owner issued 3 PDC. 2 cheques not encashed & lost their validity. 1 cheque was posted but neither encashed nor returned by bank. Bank misplaced it & it lost validity. Filing a summary suit against owner of company. Is email from owner accepting that he has not paid the money - admissible as an evidence for the cheque which was misplaced by bank?

Yes. If the owner of the company who owes you the amount gives you in writing that he has not paid the money, you can take that as an evidence while filing the summary suit in court. However, we need to see overall facts of the matter to think whether you can confidently go for summary suit since it takes heavy court fees. For further assistance please approach me.
