Delay in Repair work of Flat purchased

05-Sep-2023 (In Recovery Law)
I had purchased a flat in an under construction building in April 2021. The building didn't have an OC. Since the purchase, the walls of the flat started peeling off & water started leaking from the toilet into the kitchen but the builder has been delaying the repairs. Since the building still doesn't have an OC, will filing a Consumer Case against the builder help me resolve my grievances?

Since you have purchased the flat in an under construction building, there is no question of purchasing it without an Occupancy Certificate. However, you should have refused to accept possession for failure of the builder to provide OC at the time of possession. The consumer court can help you by giving appropriate direction to the builder to carry out the necessary repairs and also to provide with OC. You can approach me for further assistance.

Yes, you can file a consumer complaint for the quality of materials used by the builder and the inconvenience caused to you. Prior to that it is advisable to send a legal notice. For any further assistance you may get in touch with me.
