Debt settled, ECS case not withdrawn; proclaimed person, FIR ordered

08-Sep-2026 (In Recovery Law)
I live abroad. A bank filed a case in Chandigarh for an ECS bounce. I settled the loan and card by OTS and paid in full by 2 Sep 2026; the bank confirmed on email it would withdraw. On 7 Sep 2026 its lawyer stayed silent on the settlement. I was declared a proclaimed person (Sec 84 BNSS), the file was consigned and an FIR under Sec 209 BNS was directed. How do I get the case withdrawn and the proclamation/FIR cancelled without coming to India, and what do I file first?

Firstly you have to file for PO quashing in the Hon’ble Punjab and Haryana High Court and thereafter an application in the concerned district court for withdrawal of the main case. You can simultaneously file a complaint against the bank for not instructing their counsel to withdraw the complaint due to which you had to face harassment. Shubham Aggarwal
