Without any doubt this is a complicated matter however with precision and planning they can be made to release the money. Normally in recovery of money, recovery suit is filed against the other party but i dont see any advantage in filing of recovery suit as it will be very difficult to serve notice to an overseas party. Civil proceedings will be time consuming and i dont see them bearing any kind of results. The only viable solution is to take criminal action against the other party by filing an FIR against them, prima facie section 406,417,420 of the IPC are attracted against the company and its directors. The reason i am suggesting criminal action is because once am FIR is registered it becomes the job of the police to unearth the truth and Police and such agencies have the power to seek help from foreign government's and their investigative agencies to bring an accused to book.
