You'll need to file suit before civil court for damages & compensation. consumer court may not entertain such matters because a complaint before the consumer forum is maintainable when there's a consumer & service provider relation.

If water leakage from the upper flat has damaged your flat, you may be entitled to seek compensation for the loss, depending on the facts and the applicable apartment/society rules. You can generally claim compensation for: Cost of repairing the damaged ceiling, walls, flooring, or electrical fittings. Cost of repainting or restoring the affected areas. Damage to furniture, appliances, or other personal belongings caused by the leakage. Any other actual financial loss that you can prove with bills, photographs, or expert estimates. Before filing a legal case, it is advisable to: Take photographs and videos of the damage. Inform the upper flat owner in writing and request repairs. Notify the housing society or apartment association. Keep repair estimates, invoices, and other evidence of your losses.

The best approach is pursuing both the civil suit for direct recovery and a consumer complaint against the society for negligence. This dual strategy pressurizes settlement. I

Okay thank you but civil Court may take longer time. I read few cases in which consumer court ordered compensation to society committee and defaulter flat owner for the damages.
