Procedure under Order 37 Filing of Summary Suit The plaintiff files a suit clearly stating that it is under Order 37 CPC. Summons for Appearance The court issues summons to the defendant to appear within 10 days. Leave to Defend The defendant must apply for leave to defend. If the court finds a valid defence, permission is granted. If Leave is Refused If the defendant fails to appear or the court refuses leave, the plaintiff gets a decree immediately.

If a case has been filed against you under Order XXXVII of the Code of Civil Procedure, 1908, it means the bank or lender has filed a summary suit for recovery of money (usually in credit card, loan, or written contract matters). In such cases the defendant must act quickly. After receiving the court summons, you must enter appearance within 10 days before the concerned court through an advocate. After appearance, the plaintiff will serve a summons for judgment, and you must file an application for leave to defend within the prescribed time by explaining valid grounds such as incorrect calculation, excessive interest, or willingness to settle. If you do not file appearance or leave to defend in time, the court may pass an ex-parte decree against you for the claimed amount. Since it is an unsecured loan, the bank cannot directly take property but can execute the decree through legal recovery. You may also approach the bank for settlement or restructuring of dues while the case is pending. Immediate legal advice and timely court filing is important to protect your rights.
