Case already running in SCRDC for last 10 years, want to file in NCRDC

We have a property (apartment flat 1 BHK) possession case running in Mumbai Suburban SCRDC since 2015. However, for every hearing, the builder somehow manages to influence our lawyer and the case has been prolonging for last 10 years. Can I appeal/ file this ongoing case in NCRDC?

Rather than filing your Case before NCRDC, I suggest you to file a case before the MAHA RERA! You will get faster result in terms of passing of Order in the MAHA RERA compared to NCRDC! Moreover, Court fees for filing Case before MAHA RERA against the Builder for Delayed Possession is too low, that is, mere Rs 5000!
