Car loan is NPA and want OTS but bank insisting to handover car

I took a car loan and paid emi on time for first 2 years but due to financial crises unable to pay and account got NPA however paid some money from time to time. Asked bank to either reshuffle the loan or OTS settlement but they are insisting me to handover the car by saying OTS will be only possible after evaluation. Visited bank 3-4 times but no solution. Also filed a suit against me.

If you have already filed a suit then you can always insist them for settlement and if possible don’t handover the car because if you do then it will be presumed that you are legally guilty. You can give them a legal notice stating your reason for non- compliance with the EMIs, After that you can file a case against them in consumer forum for forcing you to handover the vehicle even when you are ready to pay the remaining amount.
